Application of the ADSp 2017
We work exclusively on the basis of the German Freight Forwarders' Standard Terms and Conditions 2017 (Allgemeine Deutsche Spediteurbedingungen 2017, ADSp 2017) in their respective latest version. The ADSp 2017 are recommended for application from 1 January 2017 by the Federation of German Industries (BDI), the Federation of German Wholesale, Foreign Trade and Services (BGA), the Federal Association of Road Haulage, Logistics and Waste Disposal (BGL), the Federal Association of Furniture Forwarding and Logistics (AMÖ), the Federal Association of Business, Transport and Logistics (BWVL), the Association of German Chambers of Industry and Commerce (DIHK), the German Freight Forwarding and Logistics Association (DSLV) and the German Retail Federation (HDE).
The ADSp 2017 apply to all our services as a freight forwarder, in particular to forwarding activities, transport, warehousing and cargo handling, unless mandatory statutory provisions or express written agreements provide otherwise.
Notice of limitations of liability
Important notice: In clause 23, the ADSp 2017 deviate from the law with regard to the maximum amount of liability for damage to goods (§ 431 of the German Commercial Code, HGB) by limiting liability, in the case of multimodal transports including a sea carriage and where the place of damage is unknown, to 2 SDR/kg and otherwise limiting the standard liability of 8.33 SDR/kg additionally to 1.25 million euros per instance of damage as well as 2.5 million euros per damage event, but no less than 2 SDR/kg.
In addition, the ADSp 2017 contain further limitations and exclusions of liability, in particular in clauses 22 to 27. We recommend that our business customers read the full terms and conditions carefully.
